At BMH Construction Company ("we," "us," "our"), we understand that sometimes projects or services may need to be canceled due to unforeseen circumstances. This Cancellation Policy outlines the procedures and terms related to cancellations of construction services and contracts.
1. Cancellation by Client
Clients may cancel their construction project or service contract under the following conditions:
-
Prior to Project Start: If the project has not yet started, clients may cancel the contract without incurring any penalties, except for any non-refundable deposits or costs already incurred for materials or permits.
-
During Project Execution: If a client wishes to cancel a project after work has commenced, cancellation fees may apply. The client will be responsible for covering the costs of all work completed up to the cancellation date, including labor, materials, permits, subcontractor fees, and other expenses.
2. Non-Refundable Deposits
All deposits made at the time of signing the contract are non-refundable unless otherwise specified in the agreement. These deposits cover initial project planning, materials, and other preparatory work.
3. Notice of Cancellation
To cancel a project, the client must provide written notice via email, mail, or in person. The cancellation notice should include:
- Client’s full name and contact information
- Project details, including contract number and project address
- Reason for cancellation
Upon receipt of the cancellation notice, BMH Construction Company will provide confirmation of the cancellation and a final invoice for any outstanding costs.
4. Cancellation Fees
If a project is canceled after work has begun, the client will be responsible for the following:
- Work Completed: Payment for all labor, materials, and subcontractor services rendered up to the cancellation date.
- Materials Ordered: Payment for any materials or equipment that have been specially ordered for the project and cannot be returned.
- Administrative Fee: A cancellation fee may apply to cover project management, coordination, and administrative costs.
5. Cancellation by BMH Construction Company
We reserve the right to cancel a project under the following conditions:
-
Client Violation of Contract: If the client fails to adhere to the terms and conditions outlined in the contract, we may cancel the project and charge for work completed and any associated costs.
-
Unforeseen Circumstances: If circumstances beyond our control (e.g., natural disasters, supply chain issues, or government orders) prevent us from completing the project, we will provide notice to the client and refund any unspent portion of the project fee.
6. Project Delays
If a client wishes to delay the project rather than cancel it, we will accommodate such requests whenever possible. However, additional fees may apply if the delay results in increased project costs (e.g., price changes in materials or labor).
7. Dispute Resolution
In the event of a dispute regarding cancellation, both parties agree to resolve the matter through mediation or arbitration as outlined in the project contract, before pursuing legal action.
